Notice period

A notice period is the amount of time an employee or employer must give before employment ends, as set out in an employment contract or by law.

What is a notice period?

A notice period is the time between the day notice is given and the last working day. It gives both sides time to prepare — whether that’s wrapping up work, handing things over or planning for what happens next.

The length of the notice period is usually set out in the employment contract, but legal minimums may also apply, and it’s often shorter during probation. Sometimes an employer may end employment straight away and pay the notice instead or keep the person on payroll while asking them not to work (garden leave).

Things to know

  • Notice periods can apply when someone resigns or when an employer ends employment
  • In the UK, statutory notice increases with service (up to 12 weeks after 12 years), while contractual notice may be longer - many roles set notice at around three months
  • The notice period may be contractual, statutory or a mix of both
  • Notice periods are often shorter during probation
  • In some cases, the employer may use payment in lieu of notice or garden leave
  • Clear notice terms help avoid confusion and support a respectful exit

Do I have to work my notice period?
